1. Acceptance of These Terms

These Terms of Service (the “Terms”) govern your access to and use of the Black Lantern Tattoo Studio website (the “Site”). By visiting, browsing, or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

If you do not agree, do not use the Site. The Site is intended for users who are at least 16 years old. If you are under 16, you may use the Site only with the involvement of a parent or legal guardian.

2. Important Disclaimers (Tattoo Services)

The Site provides informational content about Black Lantern Tattoo Studio and a way to request a quote or consultation. The Site does not provide medical advice. Tattoos involve skin trauma and a healing process. If you have medical questions, allergies, or conditions that may affect healing, consult a licensed healthcare professional.

• Clients are responsible for design decisions and placement choices.

Results can vary by skin type, placement, aftercare adherence, and other factors. Any references to timing, healing, or outcomes are general guidance and are not guarantees.

3. Description of the Site and Changes

The Site may include pages describing our services, studio practices, artists, a gallery, frequently asked questions, and contact methods. We may update, modify, suspend, or discontinue any part of the Site at any time without notice.

Content is provided “as is” and may contain typographical errors or outdated information. We try to keep details accurate, but we do not promise that all content is complete, current, or free of mistakes.

4. Booking Requests and Communications

If you submit a request through a Site form, you agree to provide accurate information and to receive communications related to your request. Submitting a request does not guarantee availability or confirm an appointment. Appointments are confirmed only after follow-up and scheduling confirmation by Black Lantern Tattoo Studio.

You are responsible for ensuring that your email address and phone number are correct. We are not responsible for missed communications due to spam filters, incorrect contact details, or carrier restrictions.

5. Acceptable Use

You agree not to misuse the Site. In particular, you will not:

9. Limitation of Liability

To the fullest extent permitted by law, Black Lantern Tattoo Studio LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Site.

To the extent any liability is not excluded, our total liability for all claims relating to the Site will not exceed the greater of (a) the amount you paid to us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Black Lantern Tattoo Studio LLC from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Site, (b) your violation of these Terms, or (c) your violation of any law or third-party right.

11. Force Majeure

We are not responsible for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, fire, flood, war, terrorism, labor disputes, pandemic conditions, internet or telecommunications outages, cyberattacks, and cloud-provider failures.

12. International Use

The Site is operated from the United States. We make no representation that the Site is appropriate or available for use in all locations. If you access the Site from outside the United States, you are responsible for complying with local laws.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. You agree that any disputes not subject to arbitration will be brought in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.

If you are a consumer who resides in a jurisdiction that provides mandatory consumer protections, you may also have rights under the laws of your place of residence.

14. Dispute Resolution and Arbitration (United States)

If we cannot resolve the dispute informally, and to the extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered in New York, New York, rather than in court.

Class actions and class arbitrations are not permitted. You and Black Lantern Tattoo Studio LLC agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

This arbitration clause does not prevent either party from seeking injunctive or equitable relief for alleged infringement or misappropriation of intellectual property rights in a court of competent jurisdiction.

15. Termination

We may suspend or terminate access to the Site at any time if we reasonably believe you have violated these Terms or engaged in activity that is unlawful or harmful to the Site or other users. The sections on intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution survive termination.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Black Lantern Tattoo Studio LLC regarding your use of the Site and supersede any prior or contemporaneous understandings.

18. Assignment

We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign or transfer these Terms without our prior written consent.

19. No Waiver

Our failure to enforce any right or provision of these Terms will not operate as a waiver of that right or provision.

20. Modifications to These Terms

We may update these Terms from time to time. Changes become effective fourteen (14) days after they are posted on this page unless a shorter period is required by law. Your continued use of the Site after the effective date means you accept the updated Terms.

21. Electronic Communications

You consent to receive communications from us electronically, including by email. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.
